DUE PROCESS

Due Process is a method of resolving disputes by setting forth and protecting the rights of persons involved in a conflict with Church personnel or institutions. The purpose of Due Process is not to resolve differences of opinion but to deal with violations of rights. Due Process in the Church provides the means to guarantee fundamental rights and freedoms. It assures every individual and institution that certain specific protections will be provided in administrative and judicial procedures.

In recognizing the rights to Due Process, the Church says explicitly that people have the right to be informed of proposed actions which affect their own rights, the right to be heard in defense of their rights, the right in the face of accusation to confront their accusers and the right not to be judged by their accusers.

There are three distinct steps in this process of guaranteeing rights: Conciliation, Arbitration and Review. It would be hoped that disputes would normally be resolved through Conciliation. Persons of good will, committed to the Gospel spirit of reconciliation, can usually resolve problems with the aid of a third person also committed to the spirit.
